על מי חלה המדיניות
מדיניות זו חלה על רכישת שעונים ואביזרים בעסקת מכר מרחוק באתר COLOR BY MENDOZA או בטלפון, לשימוש אישי, ביתי או משפחתי. העוסק: טכנו דיגיטל בעמ, מספר עוסק/חברה 516311164, כתובת הרב קוק 46, חדרה. איסוף הזמנה שבוצעה מרחוק אינו משנה כשלעצמו את דרך כריתת העסקה. אין במדיניות כדי לגרוע מזכות לפי דין.
מועד הביטול הרגיל
אפשר למסור הודעת ביטול ממועד ביצוע העסקה ועד 14 ימים ממועד קבלת המוצר או ממועד קבלת המסמך הכולל את פרטי העסקה הנדרשים בחוק — לפי המאוחר. ההוראה חלה גם לפני קבלת המוצר. 14 ימים אלה אינם 14 ימי עסקים, ומניין התקופה כפוף לדין.
זכות מורחבת לאוכלוסיות זכאיות
אדם עם מוגבלות כהגדרתו בדין, אזרח ותיק שמלאו לו 65 או עולה חדש שטרם חלפו חמש שנים מקבלת תעודת עולה או תעודת זכאות כעולה, רשאים לבטל בתוך ארבעה חודשים ממועד העסקה, קבלת המוצר או קבלת מסמך פרטי העסקה — לפי המאוחר — כאשר ההתקשרות כללה שיחה עם העסק, לרבות בתקשורת אלקטרונית. לצורך הזכאות אפשר לבקש את התעודה המתאימה לפי החוק, ולא הוכחות נוספות שלא נדרשות בו. אין לשלוח מסמכי זיהוי בעזרה הכללית באתר; אפשר לפנות בטלפון לתיאום אופן מסירת האישור הנדרש.

לפי בחירתך: בטלפון 050-3553311 או בעל פה במקום העסק; בדואר רשום ל־הרב קוק 46, חדרה; בדוא״ל color@mendozalondon.com; או דרך קישור ״ביטול עסקה״ הבולט בדף הבית: https://color.mendozalondon.com/#ColorService. אין חובה להשתמש דווקא בטופס מסוים או לקבל אישור מוקדם לשם מסירת הודעת ביטול. יש לציין שם ומספר זהות כנדרש בדין; מספר ההזמנה יסייע באיתור. אין למסור מספר כרטיס מלא או קוד אבטחה.
ביטול עקב חרטה והחזרת המוצר
בביטול שאינו עקב פגם, אי־התאמה, איחור באספקה או הפרה אחרת מצדנו, ייגבו דמי ביטול בשיעור 5% ממחיר המוצר/העסקה שבוטלו או 100 ₪ — לפי הנמוך. נשיב את הסכומים ששולמו בעד העסקה שבוטלה, לרבות דמי המשלוח המקוריים ששולמו, בניכוי דמי הביטול המותרים בלבד. לא נוסיף עליהם דמי טיפול, אריזה, סליקה או משלוח. עליך להחזיר את המוצר ל־הרב קוק 46, חדרה ועל חשבונך; אפשר לתאם החזרה בטלפון.
פגם, אי־התאמה, איחור או הפרה שלנו
אם הביטול נובע מפגם במוצר, מאי־התאמה לפרטים שנמסרו, מאי־אספקה במועד שנקבע או מהפרה אחרת שלנו, לא נגבה דמי ביטול. נשיב את הסכום ששולם ונבטל את החיוב לפי הדין. אם המוצר נמסר, עליך להעמידו לרשותנו במקום שבו נמסר ולהודיע לנו; נתאם את איסופו על חשבוננו. תמונה ותיאור הבעיה יסייעו לבדיקה, אך בקשת תיעוד אינה מבטלת זכות או מאריכה מועד השבה הקבוע בדין.
מתי ואיך מוחזר הכסף
בתוך 14 ימים מקבלת הודעת הביטול נשיב את הסכום המגיע, נבטל את חיוב העסקה ונמסור עותק של הודעת ביטול החיוב, בהתאם לדין. איננו מחליפים החזר כספי המגיע לפי דין בשובר קנייה בלי הסכמתך. מועד הופעת הזיכוי בפירוט אמצעי התשלום תלוי גם בספק התשלום ובבנק; אין בכך לשנות את חובתנו לפעול במועד. מועד ההשבה אינו מתחיל מחדש ביום שבו הסתיימה בדיקת המוצר.
שימוש, אריזה וחלקים
פתיחת אריזה או שימוש כשלעצמם אינם שוללים את זכות הביטול בעסקת מכר מרחוק. מומלץ להחזיר עם המוצר את החלקים, האביזרים והמסמכים שנמסרו, ובאריזה המקורית ככל שהיא ברשותך. אם נגרמה ירידת ערך עקב הרעה משמעותית במצב המוצר, עומדת לעסק הזכות לתבוע את הנזק בהתאם לדין; אין בכך הרשאה לניכוי אוטומטי או לסירוב גורף לביטול. אל תפעילו כוח בהרכבת אביזר שאינו מתאים.
הזמנה מראש ובחירת צבע
שעונים, מסגרות ורצועות מתוך האפשרויות הסטנדרטיות שבקטלוג כפופים למדיניות הביטול גם אם הוזמנו מראש, הורכב עבורם שילוב צבעים או הוזמנו מהספק לאחר ההזמנה. בחירת צבע, מיקום כתר או רצועה מן הקטלוג אינה אצלנו חריג של ״ייצור מיוחד״. חריג חוקי למוצר שיוצר במיוחד לפי מידות או דרישות מיוחדות ייבחן רק אם מוצע מוצר כזה במפורש, ובתנאים הקבועים בדין; הוא אינו חל אוטומטית על הקטלוג הנוכחי.
החלפה וביטול חלקי
אפשר לבקש החלפה בטלפון 050-3553311. החלפה מוסכמת תלויה בהתאמה ובזמינות ואינה גורעת מזכותך לביטול ולהחזר כספי לפי דין. בביטול חלק מהזמנה נחשב את התמורה ששולמה בפועל בעד הפריטים המבוטלים לפי פירוט ההזמנה וההנחה שיוחסה להם בעת הקנייה; לא נשנה בדיעבד את מחיר יתר הפריטים או נוסיף קנס כדי לעקוף את זכויות הביטול.

The standard cancellation period
You may give notice of cancellation from the date of the transaction until 14 days after receiving the product or the document containing the transaction details required by law, whichever is later. This also applies before the product has been received. These are 14 days, not 14 business days; the period is calculated in accordance with the law.
Extended rights for eligible consumers
A person with a disability as defined by law, a senior citizen aged 65 or over, or a new immigrant whose immigrant certificate or certificate of eligibility as an immigrant was received less than five years ago may cancel within four months of the transaction, receipt of the product or receipt of the transaction details document, whichever is later, where entering into the contract included a conversation with the business, including by electronic communication. We may request the appropriate certificate permitted by law to establish eligibility, but not additional evidence that the law does not require. Do not send identity documents through the general website help feature; call us to arrange how to provide the required evidence.

Changing your mind and returning the product
For a cancellation that is not due to a fault, a mismatch, late delivery or another breach on our part, the cancellation fee is 5% of the price of the cancelled product/transaction or ₪100, whichever is lower. We will refund the amounts paid for the cancelled transaction, including the original delivery charge actually paid, less only the permitted cancellation fee. We will not add handling, packaging, payment-processing or delivery fees to that fee. You must return the product to הרב קוק 46, חדרה at your own expense; you may call us to arrange the return.
Faults, mismatch, delay or our breach
If you cancel because the product is faulty, does not match the details provided, was not supplied by the agreed deadline or because of another breach on our part, we will not charge a cancellation fee. We will refund the amount paid and cancel the charge in accordance with the law. If the product has been delivered, you must make it available to us where it was delivered and let us know; we will arrange collection at our expense. A photograph and a description will help us assess the issue, but requesting evidence does not remove a right or extend a statutory refund deadline.
When and how refunds are made
Within 14 days of receiving cancellation notice, we will refund the amount due, cancel the transaction charge and provide a copy of the charge-cancellation notice, in accordance with the law. We will not replace a statutory cash refund with a voucher without your agreement. When the credit appears on your payment statement also depends on the payment provider and bank; this does not change our obligation to act on time. The refund period does not restart when our inspection of the product is completed.
Use, packaging and parts
Opening the packaging or using the product does not, by itself, remove the right to cancel a distance-sale transaction. We recommend returning the supplied parts, accessories and documents with the product, and the original packaging if you still have it. If a substantial deterioration in the condition of the product has reduced its value, the business may claim that loss in accordance with the law; this does not authorise an automatic deduction or a blanket refusal to cancel. Do not force an accessory into place if it does not fit.
Pre-orders and colour choices
Watches, cases and straps selected from the standard catalogue remain covered by this cancellation policy even if they are pre-ordered, assembled in a chosen colour combination or ordered from the supplier after your purchase. Choosing a catalogue colour, crown position or strap is not treated by us as a “specially manufactured” exception. A statutory exception for a product specially manufactured to individual measurements or particular requirements will be considered only if such a product is expressly offered and the legal conditions are met; it does not automatically apply to the current catalogue.
Exchanges and partial cancellation
You may request an exchange by calling 050-3553311. An agreed exchange depends on fit and availability and does not limit your statutory cancellation and refund rights. If you cancel part of an order, we will calculate the amount actually paid for those items using the order breakdown and the discount allocated to them at purchase; we will not retrospectively change the price of the remaining items or add a penalty to circumvent cancellation rights.

Обычный срок отмены

Дополнительные сборы за обработку, упаковку, проведение платежа или доставку к нему не прибавляются. Дефект, несоответствие, просрочка или наше нарушение
Если отмена вызвана дефектом товара, несоответствием предоставленным сведениям, непоставкой в согласованный срок или иным нарушением с нашей стороны, сбор за отмену не взимается. Мы вернём уплаченную сумму и отменим начисление в соответствии с законом. Когда и как возвращаются деньги

Мы не заменяем положенный по закону денежный возврат подарочным сертификатом без вашего согласия. Срок отражения возврата в выписке зависит также от платёжного провайдера и банка; это не меняет нашей обязанности действовать вовремя. Использование, упаковка и комплектующие
Вскрытие упаковки или использование товара само по себе не лишает права отменить дистанционную сделку. Рекомендуем вернуть вместе с товаром полученные детали, аксессуары и документы, а также оригинальную упаковку, если она сохранилась. При снижении стоимости вследствие существенного ухудшения состояния товара продавец вправе требовать возмещения ущерба в порядке, установленном законом; это не разрешает автоматическое удержание или безусловный отказ в отмене. Не применяйте силу при установке неподходящего аксессуара.
Предзаказ и выбор цвета
Часы, корпуса и ремешки из стандартных вариантов каталога подпадают под эту политику отмены, даже если они оформлены по предзаказу, собраны в выбранном сочетании цветов или заказаны у поставщика после вашей покупки. Выбор цвета, положения заводной головки или ремешка из каталога не считается у нас исключением для «специального изготовления». Законное исключение для изделия, специально изготовленного по индивидуальным размерам или особым требованиям, рассматривается только если такой товар прямо предлагается и соблюдены условия закона; оно не применяется автоматически к текущему каталогу.
Обмен и частичная отмена
Запросить обмен можно по телефону 050-3553311. Согласованный обмен зависит от совместимости и наличия товара и не ограничивает законные права на отмену и возврат денег. При отмене части заказа мы рассчитаем фактически уплаченную сумму за отменённые товары по составу заказа и скидке, распределённой на них при покупке; мы не пересчитаем задним числом цену оставшихся товаров и не добавим штраф для обхода права на отмену.
